I. ACCEPTANCE AND FULFILLMENT OF ORDER, PURCHASE CONTRACT

The condition of validity of the electronic order is the proper completion of all mandatory fields of the order form. An order completed in this way is considered a proposal to conclude a purchase contract. The order placed by the buyer is binding and can only be revoked if this happens before the seller sends an e-mail confirming the acceptance of the order.

The buyer’s order is a draft purchase agreement, and the purchase agreement is concluded at the moment of delivery of the seller’s binding consent to this proposal (binding confirmation of the order). From this moment, mutual rights and obligations arise between the buyer and the seller.

The seller reserves the right to cancel the order or part of it before concluding the purchase contract in the following cases: the goods are no longer manufactured or delivered, or the price of the delivered goods has changed significantly. If this occurs, the seller shall immediately contact the buyer to agree on further action. If the buyer has already paid part or all of the purchase price, the amount will be refunded to their account. In this case, the purchase contract will not be concluded.

The seller also reserves the right to unilaterally cancel the purchase agreement in the case of an obvious typographical error regarding the price, description, or picture of the goods listed on the website www.werbea.com. The buyer will be informed of the cancellation of the purchase contract by telephone or e-mail.

All orders received by this store are binding. If the order is not canceled before shipment and is dispatched, the customer may be required to reimburse the shipping costs.

The buyer is automatically informed about the receipt of the order via e-mail. The expected delivery time of goods that are not in stock is stated in the product details and in the order confirmation. Each item indicates whether it is in stock. If the goods are not in stock or at the supplier, we will inform the buyer of the next delivery date.

By concluding the purchase contract, the buyer confirms that they have read and agreed to these terms and conditions, including the return policy.

II. CANCELING ORDER

If the buyer sends an e-mail notification to cancel the order before the seller has sent the order confirmation e-mail, the order is considered canceled. The order can be canceled by e-mail or by phone. When canceling, the buyer must state their name, e-mail, and order number.

III. PURCHASE PRICE OF GOODS AND PAYMENT CONDITIONS

The buyer is obliged to pay the purchase price and associated costs according to the selected delivery and payment method. If paying by cash on delivery, the buyer must accept the goods and pay the purchase price and related costs (postage, cash on delivery fee). Failure to accept the goods without withdrawing from the contract entitles the seller to recover incurred costs.

The prices listed on www.werbea.sk are valid at the time of ordering. The seller reserves the right to change prices due to exchange rate fluctuations, inflation, legislative changes, or changes in suppliers’ conditions. The buyer will be informed in advance.

All prices are in EUR (€).

The buyer can pay in the following ways:

  • Cashless payment (see “Payment Method”)

  • Card or cash upon personal collection

  • Cash on delivery upon receipt

Shipping and payment method costs will be added to the purchase price.

Goods will be handed over to the buyer after full payment unless otherwise agreed. An invoice will be issued and sent with the goods as a tax document.

The purchase price is considered paid when the full amount is credited to the seller’s account, paid in cash on delivery, or in cash upon personal collection.

Ownership of the goods passes to the buyer only after full payment.

All offers are valid while stocks last unless otherwise stated.

IV. OPTIONS FOR ACCEPTANCE OF GOODS

Goods are delivered by Geis Parcel SK Ltd. unless otherwise stated. Delivery cost is €5; cash on delivery is €1.

IMPORTANT: If the package is visibly damaged or the protective tape is broken, file a claim directly with the carrier. The seller is not responsible for transport damage. Delivery usually occurs the next business day after dispatch. The customer is notified by e-mail.

V. RIGHT OF THE CONSUMER TO WITHDRAW FROM THE CONTRACT

The buyer may withdraw from the contract within 14 days of receiving the goods without providing a reason. Withdrawal is possible even before the period begins. However, this is not a free trial period. If the buyer exercises the right to withdraw, they must return everything received under the contract. If this is not possible (e.g., the goods are consumed), monetary compensation must be provided. If goods are partially damaged, the seller may claim compensation before refunding the purchase price.

Withdrawal can be exercised via e-mail (order@werbea.com), phone, or mail at the seller’s address. The withdrawal period is maintained if the notice is sent on the last day.

The seller must refund all received payments, including delivery costs, within 14 days. However, if the buyer chose a more expensive delivery method, the seller is not obliged to refund the extra costs. The refund will be processed after receiving the returned goods or proof of return.

The buyer must send or hand over the goods within 14 days of withdrawal. Return costs are borne by the buyer.

The buyer cannot withdraw from the contract for perishable goods or goods in sealed packaging that cannot be returned for health or hygiene reasons once opened.

VI. COMPLAINTS

If you received damaged goods, follow the complaints procedure. Returns due to withdrawal are addressed in Article V.

VII. RETURN POLICY

This procedure governs how buyers can claim goods sold by the seller via www.werbea.sk.

The seller is responsible for defects present at delivery. Reduced-price items are not covered for known defects.

The buyer must inspect goods upon receipt and report visible defects immediately. Later claims of this nature will not be accepted.

The following are not considered valid complaints:

  • Goods not needed

  • Price dissatisfaction

  • Dissatisfaction with effects

Seller is not liable if:

  • The buyer caused the defect

  • The defect was known and accepted

  • Wear and tear occurred under normal use

  • Protective seals were broken

  • The claim is made after the warranty or expiry date

  • Damage was caused by force majeure

  • Goods were misused, improperly handled, or stored

Used or opened goods cannot be returned for hygiene reasons.

Goods may be returned within 7 days if unused and in original packaging. The seller will refund the amount upon receiving the returned goods.

The warranty is 24 months unless otherwise specified. If a product has an expiry or use-by date, the warranty does not extend beyond it.

VIII. DELIVERY COMPLAINTS

The buyer must check the package immediately after delivery. If damaged, notify the carrier and check the goods in their presence. A damage protocol must be recorded to start the complaint process.

If discounted goods have a defect, the buyer is entitled to a discount but not replacement.

Complaint process:

  1. Send the product to Werbea, Ltd., Jakabova 45, 821 04 Bratislava, Slovakia.

  2. Notify us. We cover transport.

  3. Package must include all accessories and documents.

  4. Do not use COD.

  5. Insure the shipment.

We do not accept goods that were further damaged by poor packaging. Goods must be clean.

You will be informed about the complaint process via e-mail or SMS.

IX. CAUTION

Products on www.werbea.sk are not a substitute for medical treatment. Their use is the buyer’s responsibility. Effects may vary. Consult your doctor in severe cases.

X. ALTERNATIVE SETTLEMENT OF DISPUTES

According to Act 391/2015 Coll., consumers may resolve disputes through ADR entities. If the seller does not respond within 30 days to a complaint, the consumer may contact an ADR.

XI. FINAL PROVISIONS

By placing an order, the buyer agrees to these terms and confirms they have read them. The version valid at the time of the order applies unless otherwise agreed. Updates will be published on www.werbea.com.
